NEPAL: DEEPENING HUMAN RIGHTS CRISIS



Insecure place for defenders


1.      INTRODUCTION

This paper provides an overview of human rights situation and highlights key challenges faced by human rights defenders. A set of recommendations are outlined in a form of ‘way forward’ points for national and international human rights community and concerned stakeholders to consider.

OVERVIEW OF CONTEXT

Nepal’s road towards peaceful political resolution is in the verge of fragility, instability and deteriorating law and order. Following the dissolution of the Constituent Assembly (CA) in May 2012, the country is in an untoward position that has jeopardized the peace and constitutional processes. Prolonged transition has adversely impacted on the public life in all sectors. Local government bodies remain vacant for over a decade. Most of the constitutional bodies do not have office bearers. The number of judges at the apex court has now decreased to only one-fourth; it will face further fall off this year. Most of the past political commitments, including the 2006 comprehensive peace agreement (CPA), have turned bleak – impunity deepens, transitional justice mechanisms are far from introduction, and political manipulation of state mechanisms overshadows the rule of law. The situation of human rights defenders, who have the role to raise these issues for improvement, is more than serious and sensitive. Cases on the ground vividly tell a consistent story: Nepal is an insecure place to work as an effective human rights defender.

3.      UNDERLYING CHARACTERISTICS OF CURRENT CRISIS

3.1   Weak rule of law and persistent impunity
The World Justice Project Rule of Law Index 2012, ranked Nepal 83rd among 97 countries surveyed in terms of guaranteeing access to civil justice.[1] The number of inmates in Nepal in 2006 was 8,000 which soared to 14,000 by the end of 2012.[2] Corruption cases[3] are not dealt with properly despite growing public concerns.

The reality is different than commitments. Unlike commitments in the CPA and the Interim Constitution 2007, one of the most serious reasons of current human rights crisis in Nepal is resulted from the weak state of rule of law and deepened culture of impunity. Current government is withdrawing criminal cases, ignoring court rulings and promoting blanket amnesty to perpetrators of serious crimes against humanity.[4] Criminalisation of politics is factoring into this ‘encouragement’. The government has been promoting alleged perpetrators of human rights violations within the government agencies.[5] The Prime Minister and Attorney General, beyond their jurisdictions, are directing local attorneys to sideline cases against perpetrators of disappearance, torture and unlawful killings.[6]

3.2   Pledges proved mere lip services
During the UN HRC UPR early 2011, the Government of Nepal had made commitments to complete the writing of a new constitution by May 2012 by ensuring full participation of people from all strata of social life and by guaranteeing fundamentals of rights and freedom. Immediate formation of transitional justice mechanisms, including a Truth and Reconciliation Commission (TRC) in compliance with international standards, effective implementation of court orders and bringing perpetrators of major conflict-era human rights violations to justice were other key commitments made by the government.[7] However, neither the constitution is promulgated nor the transitional justice mechanisms are put in place. Rather the existing CA has been diminished. Uncertainties loom large around the political spectrum. Political predictions are very difficult to work at the moment.

3.3   Disregard for human rights concerns
UN OHCHR released a ‘Nepal Conflict Report 2012’ in October 2012 by highlighting the patterns and cases of serious violation of international law.[8] However, the Government of Nepal abruptly dismissed the report questioning its legality. It was mainly due to the government’s systemic attempt to black out the conflict-era violations. Similarly, the government has been trying to weaken the national institution—the National Human Rights Commission, which is a constitutional body—in Nepal. The Commission’s recommendations are largely ignored by the government bodies.

3.4   Increasing violence against women
In recent days, cases of violence against women are on the rise as is their reporting in the media. Lack of awareness, weak law and order situation, growing impunity and absence of government mechanisms to address such cases are a few causes of the problem. Even the government office holders are involved in some of the ‘high-profile’ cases. They enjoy ‘freedom’ – thanks to the culture of impunity.

3.5   Freedom of expression in limbo
Disregard to freedom of expression and repeated attacks against the press by ruling party leaders and the Prime Minister has put serious threats against journalists, especially when covering human rights issues. Recently, media persons who were demanding justice to the family of a deceased journalist in Dailekh were attacked by ruling party UCPN (Maoist) cadres – about a dozen journalists were displaced for over a week. In Kavre, a town near by Kathmandu, journalists were attacked by Maoist cadres when they were reporting a programme attended by the Prime Minister. These are a few representative cases.

4.      A DANGEROUS PLACE FOR HUMAN RIGHTS DEFENDERS

4.1   Threats against human rights defenders
The government ministers and mouthpieces of ruling party media outlets are at the forefront to pose threats against human rights defenders. Last month, four human rights defenders, including the Chairperson of Informal Sector Service Centre (INSEC) Subodh Raj Pyakurel, were threatened by a number of Maoist-affiliated publications.[9] These publications have made fake allegations against the human rights defenders as “janadushman (enemies of the people)”, and, more seriously, have incited “janakarwahi (public punishment and physical attacks)” against them. The government, which has the prime responsibility to protect, is as silent as are they instigated by the Maoist party.

4.2   Victim families are silenced
Families of the victims of past human rights violation cases are another group of target. In an incident, during recent protests against impunity and gender-based violence in Kathmandu, Ms Sabitri Shrestha was approached by an unidentified person and warned that her life was in danger after she publically displayed a photograph of the former CA member, Bal Krishna Dhungel. This is because Dhungel was convicted by the Supreme Court of killing Sabitri’s brother, Ujjan Kumar Shrestha, and is enjoying impunity.[10]

Mr Janak Raut, a torture survivor whose case is currently pending in a British court faces an alarming threat from unknown persons. Nepal’s army colonel Kumar Lama was arrested in the UK on the charge of being involved in serious violations, including torturing Raut during the conflict period.[11] Nanda Ram Paudel, INSEC representative in Kapilvastu district, who provided the information on the torture of Raut at an army barrack there, has been inquired by unknown persons time and again. The strategy is to silent voices for justice by posing direct and indirect threats to the victims, families and human rights defenders. There is a cause to fear these: Absence of protection mechanism.

4.3   Self-censorship
One of the major, immediate consequences of rampant insecurity is the increased self-censorship amongst human rights defenders and victims; many of them are becoming less outspoken and less active in their human rights work, and in some cases, are increasingly isolated. Victim families have reported that they are kept in silence by direct and indirect threats from perpetrators. A victims’ leader from Bardiya district says, “The situation will become more dangerous. We were initially trying to use the current human rights momentum to file the cases in the court but our current assessment is that if we register any of the cases, then Bardiya will become next Dailekh.”[12]

4.4   Witnessing is a risk
The situation is that the witnesses do not feel secure if they try to come out as witnesses of any human rights violation case. Fact-finding reports from Dailekh district suggest that there is a possibility of retaliation against witnesses who may be asked to appear before the court to testify. Similarly, victims in Bardiya district are concerned about possible witness intimidation and attempts to destroy witness testimonies, which will negatively impact the ongoing investigations, let alone future investigations of the cases.

5.      WAY FORWARD

·         Formation of a new consensus government has become a central issue to deal with all others including the peace and constitutional processes.
·         Establishment of transitional justice mechanisms in pursuant to international standards is another most important area of concern for respecting human rights and combating impunity.
·         Unless and until strong political will is translated into practice, there is a huge chance of increasing ‘politicisation of crimes’ and ‘criminalisation of politics’. Stopping the government at least from the current trend of withdrawing criminal cases is an immediate entry point of advocacy.
·         Engaging and exerting pressure on the government to implement court verdicts and promoting the value of independent judiciary is yet another issue that requires coordinated efforts.
·         Implementing recommendations of the National Human Rights Commission, adopting measures to protect human rights defenders, including victims, and dealing with gender-based violence need to be taken into consideration by all concerned stakeholders. These require greater commitments from the government and political parties as well as practical realisation of the national and international human rights standards. Combating gender-based violence more effectively requires immediate amendment to discriminatory laws and establishment of a fast-track court system.

[10]Dhungel was convicted of killing Ujjan Kumar Shrestha and sentenced to life imprisonment by the district court and Supreme Court. The UCPN (Maoist)-led government requested the President to pardon Dhungel who is yet to serve his sentence and remained an active member of the CA until its dissolution. 
[12] In Dailekh, investigation on Dekendra Thapa’s case has been very difficult for police and attorney due to direct pressure for withdrawal from the Prime Minister and Attorney General in Kathmandu. Journalists and human rights defenders in the district faced direct and indirect threats from Maoist party – some of them were forced to displace. Later on, due to nationwide protests by human rights defenders, the Maoists agreed to let the displaced journalists return to their district.

Torture in Nepal: Practice and Challenges

The lines explain how traditional Hindu society takes torture as commonly usable method to tame others.

Torture had three facets; Traditional, Structural and Domestic. The fourth; Globalization has been added under the titles of global Security and fight against Terrorism.

Background
Nepal is the party to Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment CAT ratified on 14 May 1991, and the Interim Constitution of Nepal criminalized torture in 2007, there has yet to be a separate and specific act for criminalizing torture. It has not ratified the optional protocol (OPCAT) in spite of strong demand from the civil society. Nepal is one of the first 7th countries of the world that  expressed commitment against  torture .Nepal had extend support when Sweden proposed a resolution against torture in the third committee on the UN general Assembly  in 1973 . After more than two decades of continuous pressures from human rights community, the “Torture, Degrading Treatment, Punishment and Compensation Act 2012,” which criminalizes torture, has been registered at the Parliament Secretariat.

In the political life of Nepal, Civil Society led by Human Rights Defenders has been instrumental in all political changes. That was the reason of ratification of most important human rights convention in 1991 by the interim government after dawn of democracy. But same thing could not happen after second Peoples’ Movement of 2005, which has brought drastic changes in the political life of Nepal; by declaring Nepal Republic and Federal. It shows how adamant are the political players towards correcting the predecessors culture and state structures of delivery of justice.

This law fails to meet normative standards to prevent torture. The main objective of the law is to compensate torture victims in a very limited way, not prosecute the perpetrators. The legislative framework in Nepal is does not have any additional provisions to prevent torture. It is not mentioned in the existing criminal law in the country.

Witness protection:
There is no witness protection law in Nepal. To make matters worse, it is neither a practice of the courts in the country to ensure any form of protection to the witnesses or to the victims when an accused is released on bail in a criminal case. It is common practice in Nepal for the accused in crimes, to intimidate and threaten witnesses and victims.

Nepal conflict Report
Recent document by OHCHR titled Nepal Conflict Report studied 9000 Cases based primarily on the Human Rights Documentation by several Nepali NGOs, National Human Rights Commission (NHRC) and Victim Profile posted by INSEC, has been instrumental to establish that the culture of torture was rampant during the decade old ‘Peoples’ War’. Most of the cases during that period fall under the War-Crime, thus considered Serious Crime against Humanity. The conflict report submits that out of 14000 cases 9000 were of very serious nature and attracts immediate redressed and justice. In the name of ‘People’s War’ by Unified Communist Party) UCPN (Maoist) and security by Security personnel serious crimes were conducted against perceived opponents and so-called informers ranging from heinous killing, torture, rape (molestation, maiming) and what not. Nepal law does not have any restriction on torture except that the victim is entitled to get relief if tortured within government custody. The worst form of torture is found within family. Domestic violence against women happens to be the biggest challenge. Surprisingly domestic violence is on rise every year where women are targeted victims. Cases of rape proves that our society have adopted Man-Hood as most cruel disorder.
Nepali Colonel Lama serving in UN Peace corps in South Sudan was arrested by British Government on 3rd January 2013 on the charge of torturing civilians during his command in 2005 at a district called Kapilvastu, the birth place of Lord Buddha. After his arrest we noticed hue and cry by the Prime Minister and his Party Chief Comrade Pushpa Kamal Dahal. They framed that none of the cases relating with conflict era should be examined by criminal justice system be it related with State or the Rebels. It gave an account of fantastic partnership of rebels and rulers.
Lack of accountability
Although torture is not a specific crime in Nepal, the Nepali government is bound by international law to ensure that serious international crimes such as torture are investigated and those responsible are prosecuted. The failure to prosecute these cases also contradicts the Nepal government’s public pronouncements about delivering justice for wartime atrocities and orders of the Nepali Supreme Court to investigate and prosecute wartime abuse cases. Several people alleged to be responsible for these abuses from both the Nepali security forces and the former Maoist insurgents have been promoted, some to positions in which they can directly interfere in criminal investigations[2].

Torture Still Continues
The perpetrators of the human rights violations continuously enjoy impunity and victims are routinely denied justice. This has only strengthened the culture of impunity and lowered the people’s confidence in the potential success of the People’s Movement. Popular calls for a comprehensive transitional justice mechanism have also been ignored. Nepal has witnessed a number of commissions of enquiry that have been empowered to investigate and reveal the facts of human rights violations; yet not a single recommendation has been implemented.[3]

The custodial torture has significantly increased in the percentage as per the latest reports. This increase is due to the ongoing political instability in the country and growing activities of armed groups in several districts of Terai region. Among others, there has been a significant increase in the percentage of torture on female detainees According to Advocacy Forum an organization documenting custodial torture in 5 thousand cases they monitored in 57 districts it is found that more than 35% were tortured in police custody. In 2011 and 1012 average tortured victims in custody is Male 22% and Female 12%. It is astonishing that 34% of the children in custody have been inflicted torture out of 474 cases.


Conclusion and recommendations
All victims of torture require a comprehensive holistic treatment from a multidisciplinary team to achieve complete reparation/rehabilitation. The government of Nepal should take immediate action to have a mechanism for reparation of victims of torture as Nepal has ratified the Convention against Torture; Torture is not considered as a criminal offense thus the law enforcing agencies are enjoying complete impunity. Nepal should take effective procedure to prosecute those responsible for “widespread and deliberate practice of torture” in coming days.

Upholding the value of Human Dignity, Pluralism and Human Rights can only make us free from fear and infliction of torture. Merchandising of politics and Globalization of Market has given free hands to the perpetrators.  Reforming values, upholding rule of law and solidifying people’s awareness can only bring solution.

संक्रमणकालीन न्यायको वास्तविकता

बाबुराम भट्टराई सत्ता सुम्पनुअघि सत्य निरुपण तथा बेपत्तासम्बन्धी आयोगको अध्यादेश जारी हुनुपर्छ भन्ने सर्त राखेर बसेका छन्। सबैलाई थाहा छ, उनले संविधान र विस्तृत शान्ति सम्झौताको बर्खिलाफ हुनेगरी जो-कसैलाई, जस्तोसुकै अपराध गरेको भए तापनि क्षमादान गर्न सकिने प्रावधान राखेर अध्यादेश तयार गरी राष्ट्रपतिसमक्ष प्रस्तुत गरेका छन्। प्रधानमन्त्री भएकाले उनको कुरा बिक्छ, सर्वत्र प्रचारित हुन्छ। त्यसैले 'असम्भव कुरा पनि राष्ट्रपतिले गरिदिए हुन्थ्यो' भन्छन्।
प्रस्तावित अध्यादेशमा अन्तरिम संविधानमा उल्लिखित दुई बेग्लाबेग्लै आयोगमार्फत् सत्य निरुपण र मेलमिलाप गर्ने तथा बेपत्ताहरुको खोजी गर्ने कुराको ठिक विपरित किन दुइवटा अध्यादेशलाई एउटैमा गाभेर एकल आयोग प्रस्तावित गरिएको होला? यसबारे उनी मौन छन्। बेपत्ताको खोजी गर्ने काम जटिल र आधुनिक अनुसन्धान प्रविधिमार्फत् खोजबिन गर्नुपर्ने विषय हो। नेपालमा उपलब्ध प्राविधिक क्षमता र संसाधनले नभ्याउन सक्छ। सत्य निरुपण गरेर मेलमिलापको वातावरण सिर्जना गर्ने भनेको द्वन्द्वका कारण, त्यसको प्रतिकूल प्रभाव र त्यसबाट सृजित असमझदारीबाट परेको प्रभावको लेखाजोखा गर्नु हो। विगतको सत्यलाई समाजले स्वीकार गरोस् र फेरि त्यस्तो घटना नदोहोरियोस् भन्ने कुरामा सामाजिक ऐक्यबद्धता निर्माण गर्नु हो। यस्तो आयोगको काम एक हिसाबले सामाजिक अनुसन्धान हो, जसले सामाजिक, आर्थिक र राजनीतिक निकासका लागि आवश्यक विवेक सिर्जना गर्छ।
सत्य निरुपण तथा मेलमिलाप आयोगले विगतका पीडित र पीडकबीच प्रत्यक्ष सम्वाद गराउने साझा चौतारीको भूमिका निर्वाह गर्छ। त्यहाँ हुने समझदारी पीडित र पीडकबीच मात्र भएर पुग्दैन। पीडित, पीडक र समाजका बीचमा हुने समझदारीले मात्र द्वन्द्वको घाउ पुर्न मद्दत पुर्यागउँछ। यस्तो आयोगले भएभरका घटना छानबिन गर्छ, अदालतले जस्तो सबै पीडित र पीडकको मामिलामा फैसला सुनाउँछ र आयोगले गर्ने फैसला अन्तिम हुन्छ, त्यसभन्दा बाहेक अन्यत्र कतै उजुर लाग्दैन भनेजस्तो गरी राजनीतिक अफवाह फैलाउने काम नेपालका नेताहरुबाटै हुने गरेको छ। आयोगको रोहबरमा पीडित र पीडकले गरेका सहमतिको अभिलेखमा समाजको प्रतिक्रिया समावेश नगरी आयोगको दस्तावेज पूर्ण ठहरिँदैन। पीडित भन्नाले स्वयं पीडित मात्र हुँदैनन्। उनका परिवार वा आफन्त चित्त बुझेन भने अदालत जान सक्छन्। प्रजातन्त्र र कानुनी शासन भएको देशमा अदालतको ढोका बन्द हुँदैन।
जबसम्म पीडित, पीडक र समाज फेरि विगतको दुःखद् घटना दोहोर्याोइने छैन भन्ने कुरामा आश्वस्त हुँदैनन् तबसम्म आयोगको काम अधुरो हुन्छ। यस्तो गम्भीर काम आयोगले मात्र कसरी गर्न सक्छ? पीडितहरु हिजोको घटनामा नोक्सानीमा परेका आफन्तको पहिचान र सम्मान देख्न तथा अनुभूति गर्न चाहन्छन्। मारिएकाहरुको परिवारलाई सरकारबाट राहत, समाजबाट सम्मान र हिजोका पीडकबाट क्षमायाचनासहित विगतको व्यवहार नदोहोर्यााउने भरपर्दो वाचा­बन्धन चाहन्छन्। राज्य र गैर­राज्य दुवैबाट सांगठनिक, नीतिगत र व्यावहारिक आश्वासन चाहन्छन्। यस्तो प्रक्रिया आरम्भ गरेपछि त्यसले एउटा वातावरण सिर्जना गर्छ। सैद्धान्तिक कुराहरुको थालनी सांगठनिक र केन्द्रीय तहबाट गर्नुपर्ने हुन्छ। यस्तो प्रयासमा हिजोका द्वन्द्वरत् पक्षका विभिन्न जिम्मेवारीमा रहेकाहरुको तत्परता र स्वीकारोक्ति आवश्यक पर्छ।
सर्वोच्च अदालतले समेत छभन्दा बढी मामिलामा न्यायको आँखा कहिले पनि बन्द हुँदैन भनेर स्पष्ट पारिसकेको छ। र, फौजदारी अपराधका मामलामा नियमित न्यायिक प्रवि्र्कयालाई संक्रमणकालीन न्यायले प्रतिस्थापन गर्न सकिँदैन। त्यस्तै नेपाल पक्ष राष्ट्र भएका अन्तर्राष्ट्रिय मानव अधिकार र मानवीय कानुनअनुसार पनि गम्भीर प्रकृतिका अपराध गर्नेलाई सत्य आयोग वा अरु कुनै मेलजोलको बहानामा माफी दिन पाइन्न। नेपालले आफ्नो देशमा यस्तो विषयमा आनाकानी गरिरह्यो भने अथवा न्यायिक निर्णयको अपहेलना गरिरह्यो भने यस्तो विषय अन्तर्राष्ट्रिय क्षेत्राधिकारको कानुन भएका राष्ट्रहरुले आफ्नो देशको कानुनबमोजिम कारबाहीको विषय बनाउन सक्छन्। जुन कुरा कर्णेल कुमार लामाको मामिलामा बेलायती कारबाहीबाट प्रष्ट भइसकेको छ।
कुनै घटना जुन शीर्षकअन्तर्गत बढी गम्भीर बन्छ, त्यसैअनुरूप त्यसको छिनोफानो हुन्छ। जस्तो बलात्कारपछि हत्या गरिएको छ भने ज्यान मार्ने कुरा बढी गम्भीर अपराध भएकाले प्रथमतः ज्यान मुद्दा र त्यसमाथि बलात्कारको सजाय थपिएर आउँछ। नेपालमा जनयुद्धको बेलामा माओवादीले आफूलाई समानान्तर राज्यको हैसियत भएको भन्ने दावा गरेको थियो। आइसीआरसीसँगको अभिलेखअनुसार माओवादीले सम्पूर्ण प्रवि्र्कया पूरा गरेर मात्र कारबाही गर्ने गरेको र युद्धसम्बन्धी कानुनप्रति आफ्नो प्रतिबद्धता रहेको पनि दोहोर्यााएकोे देखिन्छ। माओवादीले औपचारिकरूपमा प्रकट गरेअनुसार हरेक तहका कारबाहीमा राजनीतिक कमिसारको निर्णय आवश्यक हुने गर्थ्यो। यसकारण माओवादीबाट भएका अपराधहरुमा राजनीतिक र फौजी दुवै कमान्डरहरु दोषी ठहरिने अवस्था देखिन्छ।
अपराध भइसकेको अवस्थामा फौजी वा राजनीतिक कमाण्ड सम्हाल्नेले आफ्नो जवाफदेहिताअनुसार सजायको भागीदार हुनुपर्छ। युद्धसम्बन्धी अपराधलाई गम्भीर अपराध मानिएको हुनाले हिजोको युद्धकालमा गरिएका बलात्कार, यातना, बेपत्ता, सम्पत्ति कब्जा, संस्कृतिक­धार्मिक संरचना ध्वंसलगायत् विषय युद्ध अपराधमा पनि समानान्तर भएर दर्ज हुन्छन्। त्यस्ता अपराधमा कुनै पनि बहानामा माफी मिनाहा दिन पाइँदैन। नेपालमा माफी दिए पनि संसारले मान्दैन। माफीको निर्णय गर्नेहरु विगतका राजनीतिक वा फौजी कमान्डर मात्र होइन, त्यस्तो निर्णय गर्ने आयोग वा संरचनाका अधिकारीहरु पनि दण्डहीनताका पृष्ठपोषकका रूपमा दर्ज गरिन्छन्। र, अन्तर्राष्ट्रिय क्षेत्राधिकारको घेराभित्र पर्न सक्छन्। त्यतिमात्र होइन, गम्भीर प्रकृतिका अपराधको सुनुवाई गर्ने राष्ट्रिय कानुन छैन भने भूतलक्षी कानुन बनाएर भए पनि त्यस्ता अपराधको छिनोफानो गर्नुपर्ने हुन्छ।
उल्लिखित कुराले के सन्देश दिन्छ भने उतर्सिएर आवश्यकभन्दा बढी शक्ति प्रयोग गर्ने, विपक्षी ठानिएकालाई वस्तुसरह ठानेर जथाभावी आरोप लगाउने र अमानवीय सजाय दिने जस्ता अपराधमा मुछिएकाले जतिसुकै राजनीतिक वा राजकीय संरक्षणमा रहे पनि ढिलो-चाँडो फल भोग्नुपर्नेछ। यस्तो अवस्थामा ठूला-ठालुले सिमानाभित्र मात्र खुम्चिएरै बसे एउटा कुरा, नभए अन्तर्राष्ट्रिय क्षेत्राधिकारसम्बन्धी कानुन भएका मुलुकहरुको भ्रमण नगर्नु नै वेश हुने छ।
अहिले बाबुराम नेतृत्वको सरकारले 'प्रवि्र्कया आरम्भ गर्यौं भनेर संसारलाई झुक्याउन' खोजेको छ। बेपत्ता र सत्य आयोग एउटै बनाएर दुईमध्ये एउटा काम सकिएको छैन भनेर समय बिताउन खोजेका होलान्। विदेशीलाई आफूहरू अन्तर्राष्ट्रिय कानुनअनुसारको आयोग बनाउँदैछौं भन्छन् तर स्वदेशीलाई भने अनेक लाञ्छना लगाउने गर्छन्। साथै विगतमा ज्यादति गर्ने आफ्ना कार्यकर्ता पंक्तिलाई झुटो सपनामा लटपट्याउन चाहन्छन्। तर, अहिले यो झुटको पनि पर्दाफास भइसकेको छ। त्यसैले उच्चस्तरका नेताहरुले आफ्नो भागको गल्ती राष्ट्रसमक्ष सार्वजनिक हिसावले स्वीकार गर्नु नै अहिलेको आवश्यकता हो। सत्य निरुपण आयोगमार्फत् पीडितले चाहेका सबै घटनाको सम्पूर्ण विषयको सुनुवाई गर्नुपर्छ। संक्रमणकालीन न्याय गर्नुपरेको हुँदा सबै अपराधलाई सामान्य फौजदारी अपराधमा तोकिएको सजाय दिन सकिँदैन । तर प्रतीकात्मक सजायको प्रबन्ध भने गर्नुपर्छ। जस्तै अदालतलाई सहयोग गरेको हकमा अहिले पनि बीस प्रतिशत सजाय घटाउने प्रबन्ध छ। हुन सक्छ, संक्रमणकालीन मामिलामा आयोगसमेतको सिफारिसमा अपराध हेरी त्यस्तो छुट नब्बे वा उनान्सय प्रतिशतसम्म हुन सक्ने प्रावधान स्वीकार गरियोस्। सामान्य मनमुटाव, शंका र द्वेषका मामिलाहरु सत्य निरुपण आयोगमार्फत् हल गरेर कानुनी कारबाही नगर्ने सहमति पनि गर्न सकिन्छ। मुख्य कुरा सद्भावको वातावरण निर्माण गर्ने हो। र, सद्भावका लागि अहिले प्रधानमन्त्रीले गरिरहनुभए जस्तो धम्की र जबर्जस्तीको भाषा बोलेर चाहिँ हुँदैन।

मानवअधिकार बर्ष पुस्तक : जनता संगको संवाद:
नागरिकहरुले स्वतन्त्रता, न्याय र शान्तिको अनुभूति गर्न पाएनन भने मानवअधिकार धरापमा पय्रो भन्ने बुझ्नु पर्छ. प्रत्येक व्यक्तिमा अन्तरनिहित सम्मान छ जो उसले जन्मदै लिएर आएको हुन्छ. प्रत्येकको सम्मान अर्थात् पहिचान र इज्जत समान र अविभाज्य अधिकार हुन भनेर पछिल्लो पटक संयुक्त राष्ट्र संघले आर्थिक, सामाजिक, संस्कृतिक अधिकार सम्बन्धी अतिरिक्त प्रलेख जारी गर्दा पनि दोह्य्राएको छ. स्वतन्त्र नागरिकले मात्र आफ्नो राय प्रभावशाली ढंगले राख्न सक्छ र आफ्ना कौशलको सृजनात्मक ढंगले उपयोग गरेर समाजलाई सघाउन पनि सक्छ. हामी चाहन्छौँ कि सभ्य मुलुकको दर्जामा हाम्रो पनि गणना होस. आफ्नो जमात र समुदाय बाहेक अरुलाई वस्तु सरह मात्र ठान्ने र अर्काको मान मर्दन गर्न फौजी र प्रशासनिक लगायत सबै प्रकारका संरचनाको दुरुपयोग हाकाहाकी गर्ने प्रवृति लाई १९३० को दशकमा तत्कालिन सोभियत राज्यका नेता ट्राटस्कीले सामाजिक फासीवादको रुपमा परिभाषित गरेका थिए. यहि प्रवृतिको व्यवहार  सीमा पारिका देश संग गरियो भने त्यसलाई उपनिवेशवाद वा साम्राज्यवाद भन्न सकिन्छ. संस्कार, सभ्यता, अनुशासन, परिवार, समाज वा मानवता जे भनौँ यिनले हामीलाई आफु, आफ्नो समाज र राष्ट्र प्रति जवाफदेही बनाइरहेको हुन्छ. जवाफदेहिताको यो अनुभूति मानवअधिकारका सिद्धान्तका आधारमा व्यवहारमा देख्न पाइयोस भन्ने आम नागरिकको चाहना स्पष्ट रुपमा स्थापित छ. मानवअधिकारकर्मीहरुको कृयाशिल पंक्तिको एक सदस्यका नाताले हामीले देशको समग्र परिश्थिती र व्यवहारलाई मानवअधिकारका सिद्धान्त र त्यसप्रतिको हाम्रो देशको वचनवद्धतालाई समेत ख्याल गरेर अभिलेख र बिश्लेषण गर्न थालेको २१ बर्ष पुरा भयो. नेपालको शान्ति प्रकृयाका हरेक दस्तावेजमा अनेक ठाउँमा मानवअधिकारको सम्मान र दण्डहीनताको सम्बोधन गरिने कुराको वाचा गरिएको छ. अहिले अन्तर्राष्ट्रीय मानवअधिकारवादी संस्थाहरु र संयुक्त राष्ट्र संघीय प्रतिवेदनहरुले नेपालमा मानवअधिकार प्रतिको जवाफदेहीतालाई बेवास्ता गर्ने, न्यायिक प्रकृयालाई अपहेलना गर्ने र दण्डहीनतालाई हाकाहाकी संरक्षण गर्ने प्रवृति जबर्जस्त रुपमा स्थापित छ भनेर दर्शाएका छन. आजको युग अन्तर्राष्ट्रीय न्यायिक प्रणालीको युग हो. हामी  अविकशित र  संवेदनशील अवस्थामा रहेको राष्ट्र हौँ. हामीले विश्वब्यापी मान्यताका आदर्शहरुको परिपालना गर्ने कुरा आफ्नो इज्जत, पहिचान र प्रभाव लाइ अगाडी बढाउने बिषय संग प्रत्यक्ष गाँसिएको छ. आफ्ना जनताका अधिकार, सामर्थ्य र पहिचानका मामिलामा हामीले गरेका वाचाहरूको प्रगतिशील ब्याख्या गर्न सक्दा मात्र हाम्रो इज्जत बढ्छ. आफ्नै जनतालाई गाली गरेर, एक अर्काको हुर्मत लिन खोजेर कसैको इज्जत बढ्दैन. समानताको व्यवहार र समस्याहरुको दीर्घकालीन समाधान; यी दुई कुरा  नेपालीले खोजेका छन. कुल जनसंख्यामा ४० प्रतिशत तन्नेरीहरु रहेको यो मुलुक आजको नौलो ज्ञान, बुद्धि र बिवेकद्वारा प्रभावित छ. सिद्धान्त रटेर केहि हुने वाला छैन. खान र उन्नति गर्न दिने योजना चाहिएको छ. त्यसमाथि झन्डै २० प्रतिशत नागरिकलाई अप्ठ्यारो परिस्थितिमा काम गर्न बैदेशिक रोजगारीमा पठाउने राष्ट्रका राजनीतिज्ञहरुले बुझ्नै पर्ने हुन्छ कि बिदेशमा पसीना बगाउन बाध्य भएकाहरुको आक्रोश अबको दिनमा आफ्नो हैकमको रक्षा गर्न नेपालीको भविष्य बिगार्नेहरुले भोग्नु पर्ने छ. हेक्का राखनु पर्छ कि संसार भरिबाट नेपालीहरु एक आर्कासंग निरन्तर संवादमा छन र झन्डै एक तिहाइ जनता इन्टरनेटको सञ्जाल संग गाँसिन तम्तयार छन. आधा भन्दा बढि जनसंख्या दुरसंचारले एक आर्का संग गाँसिएका छन. र, यो संख्या निरन्तर बढ्दो छ.
यसबर्षको मानवअधिकार बर्ष पुस्तकले परिच्छेद ५ देखि ९ सम्म पाँच विकाश क्षेत्र बाट पाँच वटा बिषयलाई अध्ययन गरेको छ. पूर्वान्चलको पाँचथरमा मातृभाषामा शिक्षा, मध्यमान्चलको रौतहटमा दाइजोको कारण भएको महिला हिंसा, पश्चिमान्चलको कपिलवस्तुमा आन्तरिक बिस्थापितहरुको अवस्था, मध्य-पश्चिमान्चलको मुगुमा खाद्य उत्पादन र आपुर्ति र सुदूर-पश्चिमान्चलको अछाममा छाउपडी प्रथा. परिच्छेद ४ मा मानवअधिकार रक्षकको अवस्थामा प्रकाश पारिएको छ. नेपालीहरुको समग्र जीवनमा प्रभाव पारिरहेको शान्ति प्रकृयाको सन्दर्भमा परिच्छेद २ अन्तर्गत शान्ति सम्झौताका ६ बर्षको विवेचना गरिएको छ.
मानवअधिकार बर्ष पुस्तक मानव अधिकारको प्रार्थमिक सुचनाको संगालो हो. यसका आधारमा धेरै अनुसन्धान र बिश्लेषण भएका छन. यस बर्ष पनि हाम्रो मानव अधिकारको संरक्षण र सम्वर्धनमा  त्यहि चाहनाका साथ केहि सान्दर्भिक सामग्री थपेर यसको प्रकाशन गरेका छौँ. यो पुस्तक तयारीका क्रम देखि प्रकाशन सम्म समग्रमा जनता संग आधारभुत तहमा गरिने संवादको प्रतिफल हो. यसर्थ यसमा बौद्धिक बिश्लेषण भन्दा जस्ताको त्यस्तै जानकारी बढि पाइन्छ.
हामीलाई सूचना दिएर, बर्ष पुस्तकको समिक्षामा भाग लिएर सुधार प्रकृयामा सहयोग गर्नुहुने र यो काममा निरन्तर संलग्न इन्सेक परिवारका जिल्ला देखि क्षेत्र र केन्द्रमा संलग्न सबै साथीहरुमा हार्दिक धन्यवाद प्रकट गर्न चाहन्छु. यो पुस्तक प्रकाशन गर्न र अन्य संस्थागत कार्यक्रममा सहयोग गर्नुहुने दाताहरुलाई पनि हार्दिक धन्यवाद ज्ञापन गर्दछु.

विवेकशील र सफा बिरेन्द्रकेशरी


  

बिरेन्द्रकेशरी पोखरेलसंग मेरो लामो सान्निध्य रहेन. ०५८ सालमा म काठमान्डू आएपछी नेपाल मानव अधिकार संगठन संगको सांगठनिक सहकार्यका सिलसिलामा मात्र उहाँ संगको संगत बढेको हो. उहाँलाई मैले एउटा नम्र, सटिक र स्पष्ट प्रस्तोताको रुपमा पाएको थिएँ. उहाँका पुराना दौंतरी श्री बद्री प्रसाद खतिवडा वातावरण र विकाशका मामिलामा बिरेन्द्रकेशरी संगको सहकार्यको बारम्बार स्मरण गर्ने गर्नु हुन्थ्यो. राजधानीलाई तराईसंग जोड्ने बाटोको चर्चा चलेपछि सडक होइन रेल मार्गबाट जोड्नु पर्छ भन्ने बिषयमा बिशद ब्याख्या सहितको प्रतिवेदन उहाँहरुले तयार गर्नु भएको थियो. खर्च, प्रतिफल र आत्मनिर्भरताको लेखा जोखा गरिएको त्यो प्रस्ताव सरकार र सरोकारवाला सबैले सह्राएका थिए तर समय क्रममा त्यो कतै अलमलियो. नेपालको संस्कृति, इतिहास र यथार्थका बारेमा बिरेन्द्र केशरीजी बिज्ञ हुनुहुन्थ्यो. भाषिक शुद्धताको मामिलामा उहाँको लेख्न मात्र होइन वाणी समेत शुद्ध थियो. जस्तो सुकै कठिन बेला र द्वन्द्वात्मक बिषयमा पनि उहाँले तिखा अभिव्यक्तिको सहारा लिनु भएन. नेपालमा माओवादीले चलाएको शसस्त्र द्वन्द्वका कारण नेपालको राष्ट्रियतामा पार्न थालेको दुष्प्रभाव प्रति उहाँमा मैले अत्यधिक चिन्ता छाएको अनुभूत गरेको थिएँ. अध्ययनका हिसाबले एउटा इन्जिनीयर भएता पनि दर्शन, साहित्य, इतिहास र संस्कृतिका बिषयमा उहाँको पकड बेजोड नै थियो. सिंगो नेपालको चित्र उहाँको मष्तिष्कमा थियो. भौतिक बिकाशले आफुलाई जनताको दैनिकी जोड्न सक्नु पर्छ भन्ने कुरा इन्जिनियरिंगको अध्ययनको सारवस्तु हो भन्नु हुन्थ्यो. ज्ञानेन्द्रले सत्ता कब्जा गरे पछि त्यो परिस्थितिको बारेमा उहाँको निष्कर्ष संग असहमत व्यक्तिहरु मध्येको एउटा म आफै पनि हुँ. उहाँले त्यसबेलामा राष्ट्रियता र प्रजातन्त्र बीचको सम्बन्धको ब्याख्या गर्ने क्रममा प्रजातन्त्रलाइ जनता बीचको भाइचारा सम्बन्धको मजबुत कडीको रुपमा ब्याख्या गर्दै द्वन्द्वको अनिवार्य परिणतिको रुपमा राजाको सत्ता कब्जाको स्थिति खडा भएको हो भन्ने ढंगले ब्याख्या गर्नु भयो. हामीहरु भने राजाको नियत र बैधानिक अधिकारको आधारमा उनको कदमको बिरोध गर्न मुलुक भित्र र बाहिर तल्लिन थियौं. एउटा पाको व्यक्ति, शालिन र शिष्ट व्यक्तित्व बाट पनि हामी दह्रो आपत्तिको चाहना राख्थ्यौं. राष्ट्रियताको बिशद ब्याख्या उहाँले राम्ररी गर्नु भएको थियो. संबिधान निर्माणको क्रममा जसरि जातिय राज्यको माग उठ्यो त्यसको पूर्वानुमान उहाँले द्वन्द्वकालमा गरिसक्नु भएको थियो. उहाँको प्राविधिक ज्ञान चक्षुले जनसंख्या र भूगोलको समिश्रित अन्तरसम्बन्धलाई विज्ञता पुर्वक मनन गरेको थियो भन्ने कुरा मलाई आज महसुस भै रहेको छ. जनता बीचको अन्तरसम्बन्ध र सौहार्दतालाइ मानव अधिकारको दृष्टिले निर्माण गरिने न्यायिक, सामाजिक र आर्थिक योजना मार्फत संपुष्ट बनाउनु पर्छ भन्ने उहाँको मान्यता थियो. उहाँको अभिव्यक्ति, व्यक्तित्व, विवेकशील व्यवहार सबैले उहाँको सम्पूर्ण व्यक्तित्वको परिचय दिन्थे. यहाँ सम्म कि उहाँको पोशाक र आगन्तुक संग गर्ने व्यवहार पनि सम्भ्रांत र सम्पूर्ण सभ्यताका परिचायक थिए भन्दा अत्युक्ति हुने छैन.
दण्डहीनता र अविश्वासको शंकट व्यहोरिरहेको हाम्रो मुलुकले उहाँको अवशान बाट मौकामा पाउन सक्ने पाको र सहृदयी मार्गदर्शन बाट बंचित हुनु परेको छ. उहाँको स्मरणमा अरुले मानव अधिकार आन्दोलनमा उहाँको योगदान र अन्य बिशिष्ट बिषयमा चर्चा गरेका होलान. मानव अधिकार संगठनका महानुभावहरुले त्यस सन्दर्भमा उहाँको संलग्नताको ब्याख्या गरेकै होलान. त्यसैले म उहाँको बिशिष्ट सादगी र शुद्धताको स्मरण गर्दै उहाँ प्रति हार्दिक श्रद्धान्जली अर्पण गर्न चाहन्छु.

नेताज्यूको टेलोमेरेस परिक्षण:








                                                                                                            ०६९ पुष ३, मंगलवार.
दि टाइम्स अफ इण्डियाको फेब्रुअरी १७ को अनलाइन अंकमा एउटा चाखलाग्दो समाचार छापिएको छ. सन् २००९ मा औषधी बिज्ञानमा नोबेल पुरस्कार दिइएको विद्यामा आधारित यो जानकारी अनुसार प्रत्येक व्यक्तिले आफ्नो बाँकी उमेर बारेमा अब सजिलै जानकारी पाउन सक्नेछन. यसकालागि रगतको कोलेस्ट्रोल जाँच गरे जस्तै प्रकृतिको रगत परिक्षण गरे पुग्छ. यो परिक्षणले बाँकी उमेर र बुढ्यौलीका बारेमा बैज्ञानिक तवरले जानकारी दिनेछ. अर्थात अरु कति दिन बाँचिएला भन्ने थाहा पाइन्छ. प्रत्येक व्यक्तिले पिता बाट २३ र आमा बाट २३ क्रोमोजोम पाएर उसको शरीर बनेको हुँदो रहेछ. प्रत्येक क्रोमोजोममा ९२ वटा टेलोमेरेस भन्ने तत्व हुँदो रहेछ. टेलोमेरेसले क्रोमोजोमको टुप्पामा सुरक्षा दिएको हुँदो रहेछ, जुत्ताको फित्ताको शीरमा प्लास्टिक, धातुको बिर्को हाले जस्तो. त्यो टेलोमेरेस कमजोर भए अनुसार बुढ्यौली लाग्ने र मुटु रोग, क्यान्सर, विस्मृति आदि रोग लाग्न थाल्दो रहेछ. विस्मृतिको व्यवहार थाल्नेले आफ्नो आयु सकिन लाग्यो भनी बुझ्नु जाति हुने रहेछ.
हाम्रा नेताज्यू हरुले आ-आफ्नो टेलोमेरेस परिक्षण गर्नु भए हाम्रो कल्याण हुने थियो. धेरै पुरानो कुरा बिर्सने अगुवाहरु संग किन गर्नु. ०४६ को जन आन्दोलन र २०६२ को जन आन्दोलनका बेलामा उहाँ हरुले गर्नु भएको वाचा, त्यसपश्चात गर्नु भएको अनेकन सहमति, प्रतिज्ञा र बितेको ७-८ महिनामा दिनु भएको आश्वाशनहरुलाई चटक्कै भुलेर पाइलै पिच्छे उहाँहरुले फेर्ने गर्नु भएको कुरा सुन्दा सुन्दा जनता हैरान भैसकेका छन. अहिले निजी कर्मचारी विश्वदीप पाण्डे मार्फतको बाबुराम पी.एच.डी.को उर्दी सुन्दा यस्तो लाग्छ कि उहाँलाई त यो रोगले हप्ता दिनमै असाध्य च्यापी सकेको रहेछ.
भारतमा ४ हजार रुपियामै परिक्षण हुन्छ भन्छन. सके नेपालमै यो परिक्षण थालौं, नसके सबै नेतालाई उतै लैजाउँ भन्ने मेरो आग्रह हो. कम्तिमा पदमुक्त प्रधानमन्त्रीलाई त झट्टै जचाई हाल्नु पय्रो. आ-आफ्नो बाँकी जिन्दगीको अवधि र यथार्थ चाल पाएपछि अलिकति बैराग जाग्ला कि?
