Sub: Update on the political context and implications for NGO

Work: The constitution process and the role of NGOs in this process.


GOOD DEVELOPMENT
·         UCPN (M) will realize and express their formal commitment to non-violence, Utilization of available process of Democracy and Rule of law for the progressive transformation of the nation.
·         In the advent of failure to promulgate Constitution on May-27, major parties shall have to share their respective part of responsibility for the failure. Wider political critique will give avenues to the people to understand correctly; the malafide intention and impossible dreams.
·         UCPN cadres will realize that the era of war is over. They don’t need barracks and fighters. Politics driven by philosophy and actions guided by law can transform the nation.
·         The horrendous division of Nepal on ethnicity based is neither possible nor demand of the people. Impossibles are impossible. (People are rapidly realizing the fact).

ROLE OF CIVIL SOCIETY
·         After CA completes its role, by promulgating or not-promulgating the constitution, the era of wider mass mobilization will start.
·         NGO and CSO should deeply involve and widen their local community level partnership and joint initiatives for several Social, Political and Cultural agenda to create Harmony and United efforts including:
§ Justice to the victims of conflict.
§ Security from the perspective of Human Security.
§ Non-discrimination, affirmative plans and budgetary allocation.
§ People’s collective initiatives and collaboration between Government and Non-government sector.

STRATEGY
·         Dialogue, Pressure and Media mobilization.
·         Reminder of past commitments and analysis of loopholes, mistakes and blunders.
·         Encouraging progressive definition of Legal, Political and Peace Documents.
·         Public discourse through wider alliances.
·         Supporting and partnering research, analysis and sectoral initiatives.

IN (CASE) CRISIS
·         Human Rights, International Law and Past commitments are to be reminded in cognitive manner.
·         Senior and front line Human Rights Defenders should readily come forward to take the risk while expressing bitter truth.


CURRENT SITUATION
·         Maoists are the bondage of their Militarized structure and strategy of forceful implementation. (There is visible public demand to renounce violence).
·         Mainstream parties are skeptical of Maoist’s progressive agenda. Loss and deficiency in believe is an iron-gate. (Remind their past commitment, at least to start with Guiding Principles of 1991 constitution).
·         People perceive that political parties are corrupt and Madhesi parties are totally corrupt, without any political philosophy and ground for political party. (Sentiment cannot run a party).
·         Very few Civil Society leaders are in position to speak the bitter truth, albeit taking the risk.

THREE MAJOR CONCERNS
·         Impunity.
·         Discrimination.
·         Rule of Law.

SOLUTION
·         Practical resolution.
·         Adherence to letter and spirit of commitments.

THE SIMPLE TRUTH
·         Aim of Federalizing Nepal is to unite the nation.
·         Nepal is the replica of Himal-Pahad and Terai (Mountain, Hill and Low land).

Every federal state should have a composition of these three components with uniting culture. (Culture is above Ethnicity).
